PARKNUMA
PARKING PROGRAM TERMS
Introduction
These Parknuma Parking Program Terms (these “Parking Program Terms”) supplement the Parknuma End User Terms of Use (the “End User Terms”) and govern your use of parking sessions, monthly parking plans, reservations, parking permits, parking validations, and related features available through the Parknuma platform and mobile applications (the “Services”). Capitalized terms not defined herein have the meanings assigned in the End User Terms.
By booking a reservation, starting a parking session, activating a parking permit, enrolling in a monthly parking plan, or otherwise using any parking feature of the Services, you agree to be bound by these Parking Program Terms. If there is a conflict between these Parking Program Terms and the End User Terms, these Parking Program Terms will control with respect to the applicable parking feature or transaction.
Parknuma is a technology platform. We do not own, operate, or manage any parking facility. While our platform provides technology tools that assist Parking Operators with enforcement-related activities, Parknuma does not itself physically enforce parking rules, tow or remove vehicles, or direct or control any physical enforcement actions. All parking rules, pricing, availability, enforcement decisions, and physical enforcement activities are the sole responsibility of the applicable Parking Operator.
1. Definitions
“Monthly Parking Plan” means a recurring parking arrangement, billed on a monthly basis, that provides you with ongoing parking privileges at a designated facility for the duration of the plan. Monthly Parking Plans may include assigned or unassigned spaces, depending on the Parking Operator’s configuration.
“Parking Operator” means the property owner, property manager, parking facility operator, employer, homeowners association, condominium association, or other entity that operates or controls the parking facility where you park, and that uses the Parknuma platform to manage its parking operations.
“Parking Permit” means an authorization issued through the Services granting you permission to park at a designated facility, subject to the Parking Operator’s rules and any applicable terms presented during the permit activation process. Parking Permits may be associated with Monthly Parking Plans, employer or organizational parking programs, or other arrangements configured by the Parking Operator.
“Parking Session” means a single, non-recurring instance of paid parking initiated through the Services, whether hourly or daily, at a participating facility.
“Parking Validation” means a discount, credit, or subsidy applied to a Parking Session or other parking charge through a private partnership arrangement between the Parking Operator and a third-party business (a “Validation Partner”).
“Reservation” means an advance booking made through the Services for a Parking Session at a future date and time at a participating facility. Reservations are subject to the specific terms presented to you at the time of booking, including any applicable grace periods, cancellation windows, and penalties.
2. Parking Sessions
2.1 Starting a Parking Session
You may initiate a Parking Session through the Services at any participating facility that offers hourly or daily parking. When you start a Parking Session, you will be shown the applicable rate, estimated charges, and any facility-specific terms. By confirming the session, you agree to the displayed terms and authorize the applicable charge to your payment method on file.
2.2 Session Duration and Extensions
It is your responsibility to manage the duration of your Parking Session and to ensure your vehicle is removed from the facility before the session expires or before the facility’s posted operating hours end, whichever is earlier. If the Services or the Parking Operator permit session extensions, you may extend an active session through the Services. If you fail to extend or end your session before expiration, you may be subject to additional fees, penalties, or enforcement action as determined by the Parking Operator.
2.3 Session Information Accuracy
You are responsible for ensuring that all information entered when starting a Parking Session is accurate, including the correct facility, zone or area, vehicle, license plate number, and payment method. Parknuma is not liable for fees, fines, penalties, towing, or other consequences arising from inaccurate session information provided by you.
3. Monthly Parking Plans
3.1 Enrollment
You may enroll in a Monthly Parking Plan at a participating facility through the Services. Enrollment may require acceptance of additional Parking Operator-specific terms, parking regulations, or community agreements, which will be presented to you during the enrollment or permit activation process. By completing enrollment, you agree to the displayed plan terms, billing cycle, rate, and any Parking Operator-specific rules or agreements.
3.2 Billing and Auto-Renewal
Monthly Parking Plans are billed on a recurring basis on the billing date specified at enrollment. Unless you cancel in accordance with Section 7 or the Parking Operator terminates your plan, your Monthly Parking Plan will automatically renew each billing cycle at the then-current rate. The Parking Operator reserves the right to adjust rates for Monthly Parking Plans. Rate changes will be communicated to you via email to the address on file and/or through the Services at least thirty (30) days prior to the effective date of the rate change. Rate changes not communicated in accordance with this Section will not take effect until the next billing cycle following proper notice.
3.3 Assigned and Unassigned Spaces
Depending on the facility and Parking Operator configuration, your Monthly Parking Plan may include an assigned parking space (including designated EV charging spaces, where available), an unassigned space within a designated area, or general access to an unreserved lot or garage. Unless your plan explicitly includes an assigned space, you are not guaranteed a specific parking spot. Parknuma is not responsible for the physical availability of any parking space, including assigned spaces that may be temporarily occupied by unauthorized vehicles.
3.4 Parking Operator-Specific Terms
Certain facilities may require you to agree to additional rules, regulations, or agreements as a condition of your Monthly Parking Plan. These may include community parking regulations, lease addenda, condominium association rules, employer parking policies, or other facility-specific terms. Such terms will be presented to you through the Services during enrollment or permit activation, and you agree to comply with them as a condition of your plan. The Parking Operator is solely responsible for the content and legal sufficiency of any such terms. Parknuma makes no representation or warranty regarding the enforceability of Parking Operator-specific terms presented through the Services.
4. Reservations
4.1 Making a Reservation
Where available, you may book a Reservation through the Services for a Parking Session at a future date and time. When making a Reservation, you will be shown the applicable rate, grace period (if any), cancellation window, cancellation penalty (if any), and any other terms specific to the Reservation. By confirming the Reservation, you agree to the displayed terms and authorize applicable charges to your payment method on file.
4.2 No Guarantee of Availability
A RESERVATION DOES NOT GUARANTEE THAT A PARKING SPACE WILL BE PHYSICALLY AVAILABLE OR UNOCCUPIED UPON YOUR ARRIVAL. PARKNUMA DISPLAYS AVAILABILITY BASED ON INFORMATION IN ITS SYSTEM, BUT CANNOT GUARANTEE THE PHYSICAL STATE OF ANY PARKING SPACE. IF YOUR RESERVED SPACE OR AREA IS OCCUPIED BY AN UNAUTHORIZED VEHICLE OR IS OTHERWISE UNAVAILABLE DUE TO CIRCUMSTANCES BEYOND PARKNUMA’S CONTROL, PARKNUMA IS NOT LIABLE FOR ANY DAMAGES, COSTS, OR INCONVENIENCE RESULTING FROM SUCH UNAVAILABILITY. UNLESS YOUR RESERVATION EXPLICITLY STATES THAT A SPECIFIC NUMBERED PARKING SPOT IS INCLUDED, YOUR RESERVATION DOES NOT ENTITLE YOU TO A PARTICULAR SPOT.
4.3 Grace Period
Reservations may include a grace period before and/or after the scheduled start time. If you do not arrive within any applicable grace period, your Reservation may be automatically canceled, and cancellation fees may apply in accordance with Section 7. Grace period terms will be displayed at the time of booking.
4.4 Reservation Confirmation
A Reservation is not confirmed until you receive confirmation through the Services (e.g., an in-app confirmation screen and/or confirmation notification). It is your responsibility to verify that your Reservation has been successfully created before relying on its availability.
5. Parking Permits
5.1 Issuance and Activation
Parking Permits are issued through the Services in connection with a Monthly Parking Plan, an employer or organizational parking program, or another arrangement configured by the Parking Operator. You must complete any required activation steps, including acceptance of applicable terms and Parking Operator-specific rules, before your Parking Permit becomes active. An active Parking Permit serves as your authorization to park at the designated facility in accordance with its terms.
5.2 Permit Scope
Your Parking Permit authorizes you to park only at the facility, in the area or spot (if assigned), and during the times specified in the permit terms. Parking outside the scope of your permit (including in unauthorized areas, during unauthorized times, or at unauthorized facilities) may subject you to fees, penalties, or enforcement action by the Parking Operator.
5.3 Physical Permits and Placards
Certain facilities may require you to display a physical permit, placard, hang tag, decal, or other material in or on your vehicle in addition to your digital Parking Permit in the Services. It is your responsibility to obtain, properly display, and maintain any required physical materials. Failure to display required physical materials may result in penalties or enforcement action regardless of your digital permit status.
6. Parking Validations and Discounts
6.1 Availability
Parking Validations may be available at certain facilities where the Parking Operator has established a partnership with a Validation Partner (e.g., a retail store, salon, restaurant, or other business that offers to cover a portion or all of a visitor’s parking charges). The availability, terms, and value of Parking Validations are determined solely by the Parking Operator and the Validation Partner, and may change or be discontinued at any time without notice.
6.2 Application of Validations
Parking Validations may be applied automatically through the Services based on the Parking Operator’s configuration, or may require action by you (such as scanning a code, presenting a receipt, or checking in at a participating location). The specific method and timing of validation application will vary by facility and Validation Partner. Validations are applied as a credit, discount, or refund against the applicable parking charge.
6.3 Validation Rules
The following rules apply to Parking Validations unless otherwise specified by the Parking Operator or Validation Partner:
(a) Only one Parking Validation may be applied per Parking Session or transaction. Validations cannot be combined or stacked unless the Parking Operator’s configuration expressly permits it.
(b) Once a Parking Validation has been applied, it generally cannot be changed, reversed, or transferred to a different session or transaction.
(c) Any refund or credit resulting from a Parking Validation will be applied to the original payment method used for the validated parking charge.
(d) Misuse of Parking Validations, including obtaining or using a validation to which you are not entitled, may result in loss of validation privileges, account penalties, or termination of your account.
(e) The Parking Operator, Validation Partner, and Parknuma each reserve discretion over the circumstances under which a Parking Validation may apply, and may deactivate or modify any validation program at any time.
6.4 No Parknuma Liability for Validations
Parknuma is not a party to any partnership agreement between the Parking Operator and a Validation Partner. Parknuma’s role is limited to facilitating the technology that applies Parking Validations within the Services. Parknuma is not liable for the availability, value, terms, or application of any Parking Validation, or for any disputes between you, the Parking Operator, or a Validation Partner.
7. Cancellations and Refunds
7.1 Parking Sessions
Active Parking Sessions generally cannot be canceled or refunded once started. If you end a Parking Session early, charges will be calculated based on the rate structure configured by the Parking Operator (which may include minimum charges or fixed-rate periods). Whether early termination results in a reduced charge depends on the Parking Operator’s pricing configuration.
7.2 Monthly Parking Plans
Cancellation of Monthly Parking Plans is subject to the terms presented at the time of enrollment and any Parking Operator-specific cancellation policies. Unless otherwise specified:
(a) You may request cancellation of a Monthly Parking Plan by providing notice through the Services or by contacting Parknuma support.
(b) Cancellations take effect at the end of the current billing cycle. You are responsible for payment through the end of the billing cycle in which you cancel.
(c) Prorated refunds for partial billing cycles will be provided only if the Parking Operator’s cancellation policy expressly permits proration.
(d) Early termination fees may apply if your plan includes a fixed commitment period and you cancel before the end of that period.
7.3 Reservations
Cancellation of Reservations is subject to the cancellation window and penalty terms displayed at the time of booking. Unless otherwise specified:
(a) Reservations canceled before the start of the applicable cancellation window will receive a full refund.
(b) Reservations canceled after the cancellation window has closed, or after the reservation start time, may be subject to a cancellation fee or may be non-refundable, as disclosed at the time of booking.
(c) No-shows (failure to arrive within any applicable grace period) may be treated as a late cancellation and may be subject to the full reservation charge or a no-show penalty, as disclosed at the time of booking.
(d) It is your responsibility to cancel unneeded Reservations in accordance with the applicable cancellation policy.
7.4 Refund Method
Any refund, if provided, will be issued to the original payment method used for the transaction. Refunds cannot be redirected to a different payment method or account. Processing times for refunds are subject to your financial institution’s policies and may take up to ten (10) business days. Certain financial institutions or payment platforms may not accept refunds for charges beyond a specified period (e.g., 180 days); in such cases, the charge may become non-refundable. It is your responsibility to ensure that your payment method accepts refunds.
7.5 Parking Operator and Parknuma Discretion
The Parking Operator and/or Parknuma reserve the right to modify, cancel, or terminate any Parking Session, Monthly Parking Plan, Reservation, or Parking Permit at their discretion. Refund decisions for facility-specific disputes are made by the applicable Parking Operator. Parknuma may issue refunds directly for documented Platform errors. Any refund requests that fall outside the specific policies above may be considered on a case-by-case basis at the sole discretion of the applicable Parking Operator.
8. Your Responsibilities
8.1 Compliance with Parking Rules
You are solely responsible for complying with all applicable laws, regulations, and rules established by the Parking Operator or governing authority at the facility where you park. This includes, without limitation, rules communicated through:
(a) Posted signage, markings, barricades, cones, and other traffic control mechanisms at the facility;
(b) Your lease agreement or other contract with the property owner, property manager, or association;
(c) Parking regulations, guidelines, or agreements displayed through the Parknuma platform during your registration, enrollment, or permit activation process; and
(d) Any other rules or policies established by the Parking Operator, regardless of the format or method by which they are communicated.
8.2 Accurate Information
You are responsible for ensuring that all information you provide through the Services is accurate, complete, and current, including your vehicle information, license plate number(s), contact information, and payment method(s). You must promptly update your information if it changes. Parknuma is not liable for any fees, fines, penalties, towing, or other consequences arising from inaccurate or outdated information you provide.
8.3 Vehicle Registration in the Services
All vehicles parked at facilities using the Parknuma platform must be registered in the Services with accurate and current vehicle information, including license plate number. If you are parking a guest’s vehicle or a vehicle other than your own, you are responsible for ensuring that vehicle’s information is properly registered. Vehicles that are not registered in the Services may be subject to fees, penalties, or enforcement action by the Parking Operator.
8.4 Designated Spaces Only
You must park only in the space(s) or area(s) for which you have an active Parking Session, Reservation, Parking Permit, or Monthly Parking Plan. Your vehicle must be parked fully within the designated space, and no part of your vehicle may extend beyond the markings or boundaries of your designated space. You may not park in aisleways, drive lanes, fire lanes, emergency vehicle lanes, pedestrian walkways, areas designated for persons with disabilities (unless you hold a valid disability placard or plate), loading zones, or any area not authorized under your parking arrangement.
8.5 Physical Permits and Accessibility Placards
If the Parking Operator requires physical permits, hang tags, decals, or other materials, you must display them as instructed. Vehicles parked in spaces designated for persons with disabilities must display proper placards and/or license plates at all times as required by applicable law.
8.6 Vehicle Condition and Insurance
All vehicles parked at facilities using the Parknuma platform must carry insurance that meets applicable state or local requirements and must have a visible license plate (a temporary dealer plate with visible plate number is permitted). Vehicles without a visible license plate may be subject to enforcement action, including towing, at the vehicle owner’s expense. You agree to maintain your own insurance covering risks associated with parking and will look solely to such insurance for reimbursement of any resulting damages.
8.7 No Resale or Unauthorized Transfer
Parking Sessions, Reservations, Monthly Parking Plans, and Parking Permits are for your personal use only (or for use by authorized guests where the Parking Operator’s configuration permits guest parking). The offering, posting, resale, or unauthorized transfer of any parking arrangement obtained through the Services to any third party or on any platform outside of Parknuma is strictly prohibited and may result in cancellation of your arrangements, forfeiture of fees paid, and termination of your account.
8.8 No Vehicle Maintenance or Non-Vehicular Storage
No vehicle maintenance (including oil changes, repairs, or car washing) is permitted in any parking space without prior written approval from the Parking Operator. You may not use your parking space for non-vehicular storage without prior written approval from the Parking Operator. Vehicles parked at a facility must be operable unless the Parking Operator expressly permits otherwise.
9. Unauthorized Parking and Enforcement
9.1 Unauthorized Parking
Unauthorized parking includes, without limitation: parking at a facility without a valid Parking Session, Reservation, Parking Permit, or Monthly Parking Plan; parking in a space or area not authorized under your parking arrangement; parking beyond the duration of your session, reservation, or permit; parking in a manner that disrupts the use of the facility for others (including blocking aisleways, drive lanes, or other vehicles); and any other violation of the Parking Operator’s rules or these Parking Program Terms.
9.2 Enforcement Actions
The Parking Operator (and, where authorized by the Parking Operator, Parknuma’s enforcement technology tools) may take enforcement action in response to unauthorized parking, which may include:
(a) Issuance of fees, fines, or penalties through the Services, charged to your payment method on file;
(b) Notification to and/or request for towing by the Parking Operator’s designated towing service provider;
(c) Cancellation of your Parking Session, Reservation, Monthly Parking Plan, or Parking Permit;
(d) Suspension or termination of your Parknuma account; and/or
(e) Referral to law enforcement or other governmental authorities.
9.3 Penalty Fees
Penalty fees for unauthorized parking vary based on the Parking Operator’s rules and applicable law, and may vary based on factors including the number of prior violations, severity of the violation, and specific rule violated. Penalty fees will be disclosed in the Parking Operator’s rules, where available, and charged to your payment method on file. By agreeing to these Parking Program Terms, you authorize Parknuma to charge your payment method for any fees, fines, or penalties assessed by the Parking Operator through the Services.
9.4 Towing
The Parking Operator may authorize the towing or removal of your vehicle for unauthorized parking or other violations of the Parking Operator’s rules. Parknuma’s role with respect to towing is strictly administrative and facilitative; Parknuma may transmit towing requests to the Parking Operator’s designated towing service provider on behalf of the Parking Operator, but Parknuma does not itself tow, remove, direct, or control the towing of any vehicle. Neither Parknuma nor the Parking Operator is responsible for any damage to your vehicle resulting from a tow. Towing costs are your responsibility.
9.5 Vehicle Responsibility
You are responsible for all vehicles registered to your Parknuma account. By registering a vehicle, you represent that you have the right to use and/or control that vehicle and accept responsibility for any instances of unauthorized parking or violations involving that vehicle at facilities using the Parknuma platform.
9.6 Penalty Fee Review
You may request a review of a penalty fee by contacting Parknuma support or by responding to the penalty fee notification sent to you through the Services within thirty (30) days of the date the penalty fee was assessed. Requests submitted after the thirty-day period may not be considered. Parknuma and/or the Parking Operator will respond to review requests within ten (10) business days of receipt. A fee determination is final and binding upon issuance of a written response. Submission of repeated frivolous or bad-faith review requests may result in restrictions on your account.
9.7 Falsified Reports
Submitting a falsified report of any kind through the Services (including false reports of unauthorized vehicles, false parking problem reports, or false claims for refunds) may result in penalty fees, forfeiture of any applicable refund, and/or termination of your Parknuma account.
10. Payments
10.1 Parking Session Payments
Parking Sessions are billed to your payment method on file at the time the session is started or, for post-pay sessions, at the time the session ends, as configured by the Parking Operator. Applicable charges will include the parking rate, any applicable taxes, and any processing or service fees.
10.2 Monthly Parking Plan Payments
Monthly Parking Plans are billed on a recurring basis on the billing date specified at enrollment. If you fail to remit payment for a Monthly Parking Plan, your plan may be suspended or canceled. If your plan is canceled due to non-payment, you must pay any past-due balance before re-enrolling. You are not guaranteed the same space or rate if you must re-enroll after cancellation due to non-payment, and any previously applied discounts or rate reductions may no longer be valid.
10.3 Reservation Payments
Reservations are billed to your payment method at the time of booking, unless the Parking Operator’s configuration specifies otherwise (e.g., charge at session start). The applicable rate, taxes, and any fees will be displayed before you confirm your Reservation.
10.4 Failed Payments
If a payment fails due to an expired, invalid, or declined payment method, Parknuma may attempt to charge an alternative payment method on your account, if available. Repeated failed payments may result in suspension or cancellation of your parking arrangement and/or a failed payment fee, as disclosed in the applicable terms or fee schedule.
10.5 Payment Method
It is your responsibility to ensure that any payment method associated with your account is accurate, current, and authorized for use. You must promptly update your payment method if it changes. Adding a payment method to your account that you are not authorized to use may result in cancellation of your parking arrangements, penalties, and loss of access to the Services.
10.6 Payment Disputes
If you have questions regarding charges, you must contact Parknuma support at [email protected]. Filing a payment dispute or chargeback directly with your card issuer for any charge from Parknuma or a Parking Operator processed through the Services may result in penalties, including cancellation of your parking arrangements, suspension or termination of your account, and/or additional fees. You agree to attempt to resolve any billing disputes directly with Parknuma before filing a dispute with your financial institution.
10.7 Price Changes
The Parking Operator reserves the right to adjust parking rates at any time. For Monthly Parking Plans, rate changes will take effect at the beginning of the next billing cycle following notice. For Parking Sessions and Reservations, the rate displayed at the time of the transaction will apply.
11. Parking Problems and Disputes
11.1 Reporting Parking Problems
If you experience a parking problem at a facility (including, without limitation, an unauthorized vehicle in your assigned space, physical obstructions, safety concerns, or equipment malfunctions), you should report the issue through the Services or contact the Parking Operator directly. Parknuma may facilitate the transmission of problem reports to the Parking Operator but is not responsible for resolving parking problems at any facility.
11.2 Resolution by Parking Operator
All parking problems and facility-related disputes are between you and the Parking Operator. Parknuma may, at its discretion, assist in facilitating communication between you and the Parking Operator, but has no obligation to resolve any parking problem or dispute. Parknuma is not liable for any damages, costs, or inconvenience arising from parking problems at any facility.
11.3 Temporary Relocations
Parking spaces may be subject to temporary unavailability due to facility maintenance, repainting, cleaning, repairs, construction, or special events. The Parking Operator may require you to temporarily relocate your vehicle. Parknuma is not responsible for refunds or compensation for temporary relocations required by the Parking Operator, unless the Parking Operator’s policies provide otherwise.
12. Modifications and Termination
12.1 Modifications by Parking Operator
The Parking Operator reserves the right to modify facility rules, parking arrangements, pricing, hours of operation, space assignments, and other terms at any time. Parknuma will make reasonable efforts to communicate material changes to you through the Services, but is not responsible for the Parking Operator’s decisions regarding modifications.
12.2 Termination of Parking Arrangements
The Parking Operator and/or Parknuma may terminate or suspend any Parking Session, Reservation, Monthly Parking Plan, or Parking Permit at their discretion, including for violation of these Parking Program Terms, the End User Terms, the Parking Operator’s rules, or applicable law. In the event of termination by the Parking Operator for cause, you may not be entitled to a refund.
12.3 Changes to Parking Program Terms
Parknuma may modify these Parking Program Terms from time to time. Changes will become effective no earlier than fourteen (14) days after they are posted, except that changes addressing new features or made for legal reasons may be effective immediately. Your continued use of the applicable parking features after the effective date of any changes constitutes acceptance of the modified Parking Program Terms.
13. Disclaimers and Limitation of Liability
THE DISCLAIMERS, LIMITATION OF LIABILITY, AND INDEMNIFICATION PROVISIONS IN THE END USER TERMS APPLY FULLY TO YOUR USE OF PARKING SESSIONS, MONTHLY PARKING PLANS, RESERVATIONS, PARKING PERMITS, PARKING VALIDATIONS, AND ALL OTHER FEATURES GOVERNED BY THESE PARKING PROGRAM TERMS. WITHOUT LIMITING THE FOREGOING:
PARKNUMA DOES NOT GUARANTEE THE AVAILABILITY, CONDITION, SAFETY, LEGALITY, OR SUITABILITY OF ANY PARKING SPACE. PARKNUMA IS NOT LIABLE FOR LOSS OR DAMAGE TO YOUR VEHICLE OR PERSONAL PROPERTY, PARKING FINES OR PENALTIES IMPOSED BY ANY PARKING OPERATOR OR GOVERNMENTAL AUTHORITY, TOWING OR VEHICLE REMOVAL, OR ANY ACT OR OMISSION OF ANY PARKING OPERATOR, TOWING PROVIDER, VALIDATION PARTNER, OR OTHER THIRD PARTY.
PARKNUMA IS A TECHNOLOGY PLATFORM. ALL ENFORCEMENT DECISIONS, TOWING DECISIONS, FEE AND PENALTY AMOUNTS, AND FACILITY MANAGEMENT DECISIONS ARE MADE SOLELY BY THE APPLICABLE PARKING OPERATOR. PARKNUMA’S ROLE IS LIMITED TO PROVIDING THE TECHNOLOGY TOOLS THAT FACILITATE THESE ACTIVITIES ON BEHALF OF THE PARKING OPERATOR.
14. General
These Parking Program Terms are incorporated into and form part of the End User Terms. To the extent not expressly addressed herein, the terms and conditions of the End User Terms apply to your use of the parking features described in these Parking Program Terms, including the dispute resolution, arbitration, and class action waiver provisions.
